Terms and Conditions for the Austrian Gift Card

The Austrian gift voucher (hereinafter referred to as “Gift Card”) is an offering by Austrian Airlines AG, Office Park 2, P.O. Box 100, Vienna Airport, Austria (hereinafter referred to as "Austrian"). The Gift Card is a value voucher offered through the website www.austrian.com. These general terms and conditions of Austrian apply to contracts for the purchase of vouchers on the Internet.

Individuals who accept this offering (hereinafter referred to as "users") have the option to apply the value towards a future booking of a flight ticket through www.austrian.com.

These terms and conditions are applicable for the use of the Gift Card. In addition to these terms and conditions, the general carriage conditions of Austrian Airlines always apply.

The purchase of the Gift Card is only possible via www.austrian.com.

By placing an order for the Gift Card, users make a binding offer for the conclusion of a contract which requires acceptance by Austrian. Austrian's acceptance of the offer is made by sending an email confirmation to the email address provided by the users during the ordering process.

Payment for the Gift Card is possible by using a credit card accepted by Austrian (MasterCard, VISA, American Express). Once full payment has been received by Austrian an email confirmation will be sent to the user's email address provided during the ordering process. The email will include a PDF file containing the Gift Card code.

The Gift Card is issued in euros and cannot be converted to any other currency.

Consumers have the right to cancel the contract for the purchase of a Gift Card within 14 days without stating reasons. The cancellation period is fourteen days from the date of contract conclusion and starts with the receipt of the confirmation email through which the contract was concluded.

To exercise the right of cancellation, consumers must inform Austrian Airlines AG, Office Park 2, Postfach 100, A-1300 Vienna-Airport, tel. +43 5 1766 1000 of their decision to cancel this contract with a clear declaration.

You can use the sample form for this but are not obliged to do so.

To meet the cancellation deadline, it is sufficient for consumers to send the communication regarding their exercise of the right of cancellation before the cancellation period expires.

When consumers cancel a contract, Austrian Airlines must refund all payments made without delay and at the latest fourteen days from the date notification of the cancellation of this contract was received by Austrian Airlines. For this refund, Austrian Airlines uses the same means of payment that the consumer used for the original transaction. Under no circumstances shall consumers be charged any fees for this refund.

In the event of cancellation of the Gift Card, Austrian Airlines shall void the Gift Card code on the Gift Card and refund the value of the Gift Card to the means of payment used to pay for the gift voucher.

However, the right to cancel expires before the end of the 14-day period as soon as the Gift Card has been redeemed, even if only partially.

The Gift Card can only be redeemed for flight bookings and additional services originating in a Eurozone country, where the ticket price is listed in euros and where the booking is made directly through www.austrian.com. The Gift Card can only be used at the time of booking and cannot be applied retrospectively. Up to three Gift Card codes can be redeemed within a single booking.

The Gift Card is valid for 10 years from the date of issuance unless otherwise stated on the Gift Card.

The Gift Card is not personalized. Therefore, the holder of the Gift Card does not need to be the passenger for the purchased flight ticket.

If the value balance of the Gift Card exceeds the purchase price of the flight ticket the remaining balance can be used for further purchases within the validity period of the Gift Card.

If the value balance of the Gift Card is insufficient to fully purchase a new flight ticket the remaining amount can be paid during the flight booking by credit card. Only credit cards from MasterCard, VISA and American Express are accepted for this payment. Combining a Gift Card with a Miles & More mileage payment is not possible.

The Gift Card can only be used for bookings of flights with an Austrian flight number and additional services purchased during the booking process of this flight booking on www.austrian.com.

The Gift Card's value diminishes by the amount used after its redemption.

If flight tickets purchased with a Gift Card are cancelled and submitted for a refund in accordance with legal or tariff conditions the refund value will be credited back to the Gift Card.

To prevent misuse, it is recommended to keep the Gift Card secure and inaccessible to third parties. Since the Gift Card is not personalized only knowledge of the Gift Card code is required for its redemption. Particularly in the case of transferring a Gift Card the previous owner may continue to use the Gift Card code.

The value of the Gift Card is not refundable in cash. The provisions under Section 3 remain unaffected.

Austrian's liability for damages to users is excluded in cases of slight negligence. This does not apply if a duty was violated that the contract was specifically intended to provide or whose fulfilment enables the proper execution of the contract and on which users regularly rely. If Austrian is liable in principle the compensation claim is limited to the typically foreseeable damage (value of the service provided).

These limitations of liability do not apply in cases of injury to life, body or health, gross negligence or intent by employees, agents or legal representatives of Austrian as well as in cases of legally mandated liability without fault or for assumed guarantees.

Austrian assumes no liability for incorrect information provided during registration or Gift Card purchase on www.austrian.com that is not attributable to Austrian such as typographical errors in email addresses. Austrian does not issue replacement Gift Cards.

Austrian is not liable for damages to the customer caused by a third-party using the correct Gift Card code without authorization for a booking.

Austrian law (excluding the UN Sales Convention and International Private Law) applies to these terms and conditions and all legal relationships between users and Austrian unless other national law is mandatory.
