General Terms and Conditions of the austrian-breitling.com and austrian.com/breitling websites.

1. General

The austrian-breitling.com website is aimed only at consumers. Consumer - hereinafter known as the customer - is whoever is defined as a consumer in the sense of § 1 KSchG (Konsumentenschutzgesetz) [Consumer Protection Law]. By placing the order, the customer agrees to these terms and conditions and is bound by them. Deviating agreements must be in writing.

Austrian Airlines AG is a public limited company under Austrian Law based in Vienna. It is registered in the commercial register of the Vienna Commercial Court under commercial register number 111 000k.

Our offer is aimed exclusively at customers who have their residence or habitually abode in Austria.

2. Legally binding conclusion of the contract

The placement of goods on this home page does not constitute an offer but is only an invitation to you to submit an offer as per the conditions shown.

With your order on austrian-breitling.com, you thus submit a legally binding offer, which we accept through conclusive behaviour.

You submit a binding offer if you have completed the online ordering process by entering the requested information, accepted the terms and conditions and in the last ordering step, clicked on the “Order Now With Payment” button. Immediately after entering your order, you will receive an order confirmation in text form, which does not constitute acceptance of your contract offer, but rather serves as information. This order confirmation advises you that your order has been received by us. Along with your order confirmation you also receive all customer information, which you should print out for your records. If you have not received an order confirmation, please contact our customer service.

a) The customer submits a binding offer, in which they have successfully completed the order procedure provided in our internet shop.

b) Before sending the binding online order, by pressing the back button in the browser, the customer can return to the website where their customer details are stored and after checking their details, the customer can correct any errors or cancel the ordering process by closing the internet browser.

c) The customer will be informed of our acceptance by email.

The conclusion of the contract is usually in German.

3. Price and Reservation of Ownership

All prices are total prices. They include all taxes including sales tax and duties.

The goods remain the property of Austrian Airlines AG until full payment has been made.

4. Our Quality of Service

The offered product has successfully undergone comprehensive quality and safety checks in the context of the chronometer certification of the COSC (Contrôle Officiel Suisse des Chronomètres) [Official Swiss chronometer testing institute].

The provisions of statutory warranty apply. The warranty period for the delivery of moveable goods is two years from receipt of the goods.

In the case of unexpected defects, you are entitled to the Breitling SA manufacturer’s guarantee. You should therefore keep the invoice or delivery note and the manufacturer’s guarantee card. We are happy to provide you with the contents of the guarantee and all the essential information necessary for a warranty claim.

If, in individual cases, there should be a discrepancy between the product image and the information listed against the corresponding item, the information listed in the item description applies. All power rating, measurement, weight and size information are the sample values measured for the item. If the pictorial representation of a product contains decorative material, this is not included in the purchase contract or delivery, unless the product description contains any other information regarding the scope of delivery.

Complaints as well as guarantee claims are processed directly by Breitling SA (Uhrenvertriebs GmbH, Handelskai 52, 1200 Vienna).

5. Our delivery time and capacity

Because of our production time, it is anticipated that the product will be available from the end of October 2018. The customer will be informed separately about the exact date of collection.

Collection will be by appointment at the Breitling Boutique, Vienna, Kohlmarkt 3, 1010 Vienna.

6. Cancellation policy

Right of cancellation (Right of withdrawal)

As a customer, you can cancel your contract declaration (order) pursuant to § 5e Konsumentenschutzgesetz (KSchG) [Consumer Protection Law] within 14 days without giving any reason. The withdrawal period is fourteen days from the day in which you or a third party nominated by you, who is not the carrier, have taken possession of the goods.

If our obligations to provide information are not met, the withdrawal period is 12 months from the day of receipt of the goods by the customer. If the information is provided within this time period, the deadline is 14 days from the time when the information was provided.

(e.g. via a telephone call, letter, fax or email) to inform us of your decision to cancel this contract. You can use the attached sample complaints form, although this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your communication regarding your exercise of the right of cancellation before the cancellation period expires.

Consequences of cancellation

If you cancel this contract, we must reimburse all payments we received from you without delay and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this reimbursement we use the same means of payment that you used in the original transaction, unless expressively agreed otherwise; in no case will you be charged any fees for this reimbursement. We can refuse the reimbursement until we have received the goods back again or until you have provided evidence that you have sent the goods back, whichever is the earlier.

You must send or hand over the goods immediately and in any case at the latest within fourteen days from the day in which you informed us of the cancellation to

. The deadline is met if you send the goods before the fourteen day time limit.

You bear the costs of returning the goods.

You only have to pay for any possible loss in value of the goods if this loss in value is due to unnecessary handling of the goods when checking the nature, properties and functionality of the goods.

7. Your payment options for purchases against the euro

The customer undertakes to pay the purchase price in full when the contract is concluded.

You will therefore receive an email with the corresponding link to the payment page. You have the following payment options: credit card (VISA, MASTERCARD, AMEX - exclusively with the 3-DS Secure function) or on account. All credit card payments are processed via a recognised and secure company and we ensure the highest security with payments via our website.

You have four weeks from the conclusion of the contract to send us the amount due. Should you not make the payment within this time period, we reserve the right, to cancel the contractual relationship or request fulfilment of the agreement.

The delivery of the goods only takes place after receipt of payment in our bank account and the completion of the ordered products. Please note: You must be 18 years or older to place an order via austrian-breitling.com.

8. Data protection

We make use of your personal data exclusively within the framework of the statutory requirements, and always only insofar as this is required to fulfil our contractual obligations or where there is an explicit statutory authorisation or obligation to use the data. We therefore use your personal data for the purpose of your purchase and your payment of the product. Your data will be transmitted to Breitling SA, Schlachthausstrasse 2, 2540 Grenchen, Switzerland to fulfil our contractual obligations.

9. Applicable law and place of jurisdiction

Austrian law applies exclusively to the contractual relationship, excluding the reference standards of private international law and the United Nations Convention on Contracts for the International Sale of Goods. The legal regulations apply to the place of jurisdiction.

10. Severability

Should individual provisions of the contract, including these provisions, be or become ineffective in whole or in part, or should the contract have an unforeseen loophole, the effectiveness of the remaining provisions or parts of such provisions remains unaffected. The ineffective or missing conditions will be replaced by the respective legal regulations.
